Terms of Service

We build strong relationships with our clients based on honesty and trust, but like any project, we need clear guidelines through terms and conditions. This agreement is between us, Yumu Agency, and you, the client.

Summary


We will always strive to meet your needs and live up to your expectations, but it’s important that everything is documented, so we both know what’s expected, who is responsible for what, and what happens if something goes wrong. This agreement isn’t filled with complicated legal jargon or long, unreadable text. We’re not trying to trap you into something you might regret later. We’re focused on what’s best for both of us—now and in the future.

You, the client, are hiring us (Yumu Agency) for graphic design services, such as logo design, web design, and/or visual identity design, for the price listed on our website (www.yumuagency.com) or in the proposal.


What are both parties responsible for?


You: You have the authority to enter into this agreement on behalf of yourself, your company, or your organization. You’ll provide us with everything we need to complete the project on time and in the format required. You’ll review our work, provide feedback, and approve deliverables in a timely manner. Timelines go both ways, so you’ll also commit to meeting deadlines we set together. You agree to make full payment, as outlined in the invoice or on our website.

Us: We have the skills and expertise to deliver everything we’ve agreed upon, and we’ll do it professionally and on time.


Logo Design and Branding


Concepts: Within 3 business days of receiving your logo request and payment, Yumu Agency will create a logo concept for your business. Unless stated otherwise, the design will be sent to you for review via email. After receiving your feedback, we’ll make the necessary adjustments until you’re completely satisfied.

If the initial design doesn’t meet your expectations, Yumu Agency will provide up to 3 additional design concepts at no extra cost.


File Delivery: Once the final logo is approved, we’ll deliver the files in digital formats (.jpg, .pdf, .eps, .png, .ai).

Ownership: You, the client, will own the rights to the final logo design for use across any media that benefits your business. Yumu Agency reserves the right to use the logo or any versions developed during the design process in our print and online portfolios, as well as in advertising materials such as brochures and ads. You also allow Yumu Agency to use your name and/or website as a reference on our website or other business-related media. You understand that it is your responsibility to register the copyright and/or trademark for the logo design.


Payment: In exchange for the logo design, you agree to pay the full amount. You understand that the final logo remains the property of Yumu Agency until full payment is made. If this agreement is terminated, Yumu Agency retains ownership of the logo and reserves the right to complete, display, or sell it (excluding the company name).

Additionally, Yumu Agency retains ownership of all design concepts created before the final logo. Once the final invoice is paid, you will have the right to use the logo design across all media to promote your business, while Yumu Agency will still have the right to showcase the logo for promotional purposes.


Originality: Yumu Agency guarantees that the logo designs we create are original to the best of our knowledge, and we have the rights to grant you as stated in this agreement. These rights do not conflict with any other agreements.


Delays: Illness, injury, or other unforeseen events beyond Yumu Agency’s control—such as fire, theft, technical failure, or natural disasters—may cause delays of unpredictable length.


Performance Liability: Yumu Agency does not guarantee that the logo design(s), consultations, or advice will be uninterrupted or error-free. The client assumes all risks related to the quality, originality, and functionality of the logo. Under no circumstances will Yumu Agency be held liable for any damages, including lost profits, savings, or other incidental, indirect, or special damages, even if Yumu Agency has been informed of the possibility of such damages.


Note: Before agreeing to these terms, please ensure that you fully understand all the agreements outlined above. If you have any questions or concerns, feel free to contact us before confirming your agreement.


Revisions: Our packages specify the number of revisions included from the start. However, revisions cannot include completely new, unapproved elements. We’re happy to be flexible—if you want to change something or add a new element, we can provide a separate estimate for that..
